Terms of Use
Governing Law: Kingdom of Saudi Arabia

IMPORTANT — PLEASE READ CAREFULLY. These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”) and HAYYAFIT Services Company, a limited liability company established in the Kingdom of Saudi Arabia (“Hayyafit”, “we”, “us”, “our”), governing your access to and use of the Hayyafit mobile application and website (collectively, the “Platform”). By accessing, registering on, or using the Platform in any manner, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any provision of these Terms, you must not access or use the Platform. These Terms are governed by the laws of the Kingdom of Saudi Arabia, including the E-Commerce Law (Royal Decree No. M/126 of 1440H), the Anti-Cybercrime Law (Royal Decree No. M/17 of 1428H), the PDPL (Royal Decree No. M/19 of 1443H, as amended by Royal Decree No. M/148 of 1444H), and the Civil Transactions Law (Royal Decree No. M/191 of 1444H).
In accordance with the Saudi E-Commerce Law and its Implementing Regulations, the Platform is operated by the service provider identified below:

1 Definitions
In these Terms the following terms have the meanings set out below:
- “Platform” means the Hayyafit mobile application and website, including all features, content, and functionality.
- “User” means any individual who accesses, registers on, or uses the Platform.
- “Account” means the registered account created by a User on the Platform.
- “Facility Provider” means any third-party sports facility owner or operator listing facilities on the Platform.
- “Booking” means a confirmed reservation of a sports facility slot made through the Platform.
- “Services” means all features and functionalities offered through the Platform, including facility booking, Find a Buddy matchmaking, and social content sharing.
- “User Content” means any text, images, photographs, videos, reviews, or other material uploaded or submitted by a User.
- “Payment Gateway” means any third-party payment service provider integrated with the Platform.
- “Find a Buddy” means the Platform’s sports partner matchmaking feature.
- “PDPL” means the Saudi Personal Data Protection Law (Royal Decree No. M/19 of 1443H, as amended by Royal Decree No. M/148 of 1444H).
2 Platform Overview and Intermediary Role
2.1 Nature of Platform
Hayyafit is a technology platform that facilitates connections between Users and independent third-party Facility Providers. Hayyafit does not itself provide sports services, organise sporting activities, or own, operate, or control any sports facility listed on the Platform.
2.2 Intermediary Status
Hayyafit acts solely as a technology intermediary. All bookings made through the Platform represent a contractual arrangement between the User and the relevant Facility Provider. Hayyafit is not a party to any such arrangement and is not responsible for the services delivered by any Facility Provider.
2.3 No Guarantee of Availability
Hayyafit makes no warranty regarding the quality, safety, accuracy, or availability of any sports facility. Facility information is provided solely by the Facility Provider and has not been independently verified by Hayyafit.
3 Eligibility
3.1 Age Requirement
The Platform is intended for Users who are at least eighteen (18) years of age. By registering an Account, you warrant that you are at least 18 years old with full legal capacity to contract under Saudi Law.
3.2 Users Aged 13-17
Users aged 13 to 17 may access the Platform only with the prior consent and active supervision of a parent or legal guardian, who accepts full responsibility for the minor’s compliance with these Terms.
3.3 Geographic Scope
The Platform is operated in accordance with the laws of the Kingdom of Saudi Arabia.
3.4 Accurate Information
Users must provide true, accurate, current, and complete information during registration and must promptly update such information if it changes.
4 Account Registration and Security
4.1 Account Creation
Users must create an Account to access certain Platform features. Each User may hold only one Account.
4.2 Password Security
Users are solely responsible for maintaining the confidentiality of Account credentials. Account credentials must not be shared with any third party.
4.3 Account Activity Responsibility
Users are solely responsible for all activity conducted through their Account. Hayyafit must be notified immediately of any unauthorised Account access.
4.4 Suspension and Termination Rights
Hayyafit may suspend or terminate any Account where: (a) the User breaches these Terms; (b) Account activity violates Saudi Law; (c) false registration information is provided; or (d) suspension or termination is necessary to protect the Platform or its Users.
5 User Conduct and Acceptable Use
5.1 General Obligations
Users must use the Platform in good faith, in compliance with these Terms and all applicable Saudi Law, and in a manner that respects the rights and safety of other Users and Facility Providers.
5.2 Prohibited Conduct
Users must not:
- engage in harassment, abuse, threats, or discriminatory conduct towards any User, Facility Provider, or Hayyafit personnel;
- upload or transmit content that is unlawful, offensive, defamatory, or contrary to public order or morals under Saudi Law;
- engage in fraudulent, deceptive, or misleading conduct in connection with the Platform or any booking;
- misuse the booking system, including speculative bookings or false cancellations;
- facilitate or promote any illegal activity under Saudi Law, including activities prohibited by the Anti-Cybercrime Law (Royal Decree No. M/17 of 1428H);
- attempt unauthorised access to the Platform’s systems or infrastructure;
- impersonate any person or entity or create multiple Accounts.
6 User Generated Content
6.1 User Ownership
Users retain all intellectual property rights in User Content they submit. These Terms do not transfer ownership of User Content to Hayyafit.
6.2 Licence to Hayyafit
By submitting User Content, the User grants Hayyafit a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and display such content solely for operating and improving the Platform. This licence terminates upon deletion of the content, subject to legal retention requirements.
6.3 Content Standards
User Content must comply with clause 5.2. Users must not post content infringing third-party rights, featuring third parties without consent, or depicting minors inappropriately.
6.4 Platform Moderation
Hayyafit may remove, restrict, or disable access to User Content that violates these Terms or applicable law, without prior notice.
6.5 User Deletion Rights
Where available, Users may edit or delete their User Content through the Platform interface. Deletion requests may also be submitted through Hayyafit support.
7 Sports Matchmaking — Find a Buddy
7.1 Nature of Service
Find a Buddy is a technology matchmaking tool only. Hayyafit does not curate specific matches, supervise any user interaction, or guarantee that Users will find suitable sports partners.
7.2 Offline Interaction Risk
Any interaction between Users — online or in person — is undertaken entirely at the User’s own discretion and risk. Hayyafit does not verify User identity, background, or conduct, and expressly disclaims all responsibility for any User’s conduct during offline meetings or sporting activities.
7.3 Safety Guidance
Users are advised to: (a) meet other Users in public, well-lit locations; (b) inform a trusted person of their plans; (c) not share sensitive personal or financial information; and (d) report suspicious conduct through the Platform’s reporting mechanisms.
7.4 No User Verification; Emergency Reporting
Hayyafit does not conduct background checks on, or verify the identity, qualifications, or conduct of, any User. Users are solely responsible for exercising appropriate caution. In an emergency, or where a User reasonably believes there is a risk to safety, the User should contact the relevant local emergency services and may also report the matter to Hayyafit through the in-Platform reporting mechanism.
8 Sports Activity Risk and Liability Waiver
8.1 Inherent Risk
Users acknowledge that participation in sports activities involves inherent risks of physical injury, illness, and property damage, regardless of the level of care applied.
8.2 Physical Preparedness
Users are solely responsible for assessing their own physical fitness and suitability for any sports activity. Hayyafit provides no medical advice.
8.3 Voluntary Assumption of Risk
By using the Platform to arrange or participate in any sports activity, Users confirm that they voluntarily assume all associated risks.
8.4 Disclaimer for Injuries
To the fullest extent permitted by Saudi Law, Hayyafit disclaims all liability for injury, illness, accident, or damage arising from sports activities arranged through the Platform, use of any facility, or the conduct of other Users or facility staff.
9 Facility Marketplace
9.1 Third-Party Facilities
All facilities listed are owned and operated by independent Facility Providers. Hayyafit does not own, control, supervise, or manage any listed facility.
9.2 Facility Provider Responsibility
Each Facility Provider is solely responsible for: (a) accuracy of facility information; (b) safety standards and facility maintenance; (c) service quality; and (d) compliance with applicable Saudi Law.
9.3 Platform Disclaimer
Hayyafit is not liable for injury, loss, or damage arising from use of any facility, including loss from inaccurate facility information.
10 Booking Terms
10.1 Booking Confirmation
A booking is confirmed only upon: (a) completion of the booking process; (b) successful payment confirmation; and (c) receipt of a booking confirmation notification.
10.2 Slot Availability
Slot availability is provided by Facility Providers and subject to real-time change. Display of an available slot does not create a reservation until booking is confirmed.
10.3 Concurrent Conflicts
Where multiple Users attempt to book the same slot, allocation is determined by the earliest confirmed transaction. Hayyafit is not liable for slot unavailability due to concurrent conflicts.
10.4 Cancellation
Cancellations are subject to the relevant Facility Provider’s cancellation policy, which is disclosed during booking. By completing a booking, the User accepts that policy.
11 Payment Terms
11.1 Payment Processing
Payments are processed by third-party Payment Gateways. By completing a payment, the User authorises the applicable Payment Gateway to process the transaction.
11.2 Gateway Disclaimer
Hayyafit does not control Payment Gateway processing times, authorisation, or technical performance. Hayyafit is not liable for any loss arising from Payment Gateway failure or delay.
11.3 Currency and Pricing
All prices are in Saudi Riyals (SAR) and include applicable VAT unless otherwise stated.
11.4 Service Fees
Hayyafit may charge platform service fees, disclosed in the booking summary before payment is confirmed. Service fees are non-refundable unless otherwise stated.
11.5 Failed and Reversed Payments
Where a payment fails, is declined, or is reversed, the related Booking may not be confirmed or may be cancelled. The User remains responsible for any amounts properly due in respect of a Booking that has been used or confirmed.
11.6 Chargebacks and Disputed Transactions
Users are encouraged to contact Hayyafit before initiating a chargeback. Where a User initiates a chargeback or payment dispute that Hayyafit reasonably determines to be without valid basis, Hayyafit may suspend the Account and recover the disputed amount and any associated costs through lawful means.
11.7 Duplicate and Mistaken Payments
Where a duplicate or mistaken payment occurs, the User should notify Hayyafit promptly. Verified duplicate or mistaken payments will be refunded through the original Payment Gateway.
11.8 Fraudulent Transactions
Hayyafit may decline, cancel, or reverse any transaction that it reasonably suspects to be fraudulent or unauthorised, and may report suspected fraud to the relevant Payment Gateway and to the competent authorities.
11.9 VAT and Invoices
Where applicable, prices include value added tax (VAT). A tax invoice will be issued in accordance with applicable Saudi VAT requirements. VAT registration number: 314600442600003.
11.10 Settlement Timing
Settlement and payout timing depend on the relevant Payment Gateway and Facility Provider arrangements. Hayyafit does not control, and is not responsible for, Payment Gateway settlement times.
12 Refund Policy
12.1 Eligibility
Refunds are governed by the Facility Provider’s cancellation policy. Users may be entitled to refunds where: (a) a booking is cancelled within the applicable cancellation window; (b) the Facility Provider cancels; or (c) a payment error is established.
12.2 Processing
Refunds are processed through the original Payment Gateway. Hayyafit does not control refund processing timelines.
12.3 Non-Refundable Items
Platform service fees are non-refundable. Payments for bookings cancelled outside the applicable window are non-refundable.
12.4 Direct Refunds by Hayyafit
Hayyafit may, at its discretion or where required by applicable Saudi law, issue a refund directly where: (a) a Booking is cancelled within the applicable cancellation window; (b) a payment error is established; or (c) a Facility Provider fails to honour a confirmed Booking.
12.5 Facility Provider Obligations
Refunds relating to facility quality, availability, or cancellation by a Facility Provider are the responsibility of the relevant Facility Provider. Hayyafit may facilitate such refunds but does not guarantee them.
12.6 Cancellation Disputes
Where a cancellation or refund is disputed, Hayyafit may review the matter through its complaint-handling process and may liaise with the relevant Facility Provider.
12.7 Fraud and Booking Errors
Refunds arising from fraudulent transactions or established booking errors will be handled in accordance with clause 11 and applicable law.
12.8 Exceptional Circumstances
In exceptional circumstances, including facility closure or an event of force majeure, refunds or credits may be provided at the discretion of Hayyafit or the Facility Provider, subject to applicable law.
13 Intellectual Property
13.1 Hayyafit IP
Hayyafit owns or holds licences to all intellectual property rights in the Platform, including the Platform software, source code, databases and database rights, design, look and feel, trademarks, logos, and content. All rights are protected under Saudi and international intellectual property law.
13.2 User Licence
Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes.
13.3 Restrictions
Users must not reproduce, modify, decompile, or commercially exploit any Platform content without Hayyafit’s prior written consent.
13.4 Automated Extraction and AI-Training Restriction
Users must not scrape, crawl, harvest, or use any automated means to extract Platform content or data, nor use any Platform content or data to train, develop, or improve any artificial intelligence or machine-learning model, without Hayyafit’s prior written consent.
14 Third-Party Services
14.1 Third-Party Integrations
The Platform integrates with third-party services including Payment Gateways, analytics providers, and mapping services. These are governed by their own terms and Hayyafit is not responsible for their practices.
14.2 Third-Party Links
The Platform may contain links to third-party websites. Hayyafit does not control such websites and accepts no responsibility for their content or availability.
15 Platform Availability
15.1 No Continuous Availability Guarantee
Hayyafit does not guarantee Platform availability at all times. The Platform may be temporarily unavailable due to maintenance, technical failures, or circumstances beyond Hayyafit’s control.
15.2 Force Majeure
Hayyafit shall not be liable for any failure or delay in performing its obligations arising from circumstances beyond its reasonable control, including natural disasters, fire, flood, epidemic or pandemic, war, civil unrest, acts or restrictions of government or regulators, cyberattacks, denial-of-service attacks, cloud or hosting outages, Payment Gateway failures, telecommunications or internet outages, and power failures.
16 Limitation of Liability
16.1 Aggregate Cap
To the fullest extent permitted by the Civil Transactions Law and other applicable laws of the Kingdom of Saudi Arabia, Hayyafit’s total aggregate liability to any User for all claims arising out of or in connection with these Terms shall not exceed the total amounts paid by that User to Hayyafit in the twelve (12) months preceding the event giving rise to the claim.
16.2 Direct Loss Only
Hayyafit shall be liable only for direct and actual damage proven to have resulted from its breach. To the extent permitted under the Civil Transactions Law, Hayyafit shall not be liable for any indirect or consequential loss, including loss of profits, revenue, data, or opportunity.
16.3 Specific Exclusions
Subject to clause 16.4, Hayyafit excludes liability for: (a) Facility Provider conduct; (b) other Users’ conduct; (c) sports injuries; (d) Payment Gateway failures; (e) inaccurate Facility Provider information; and (f) booking conflicts.
16.4 Non-Excludable Liability
Nothing in these Terms excludes or limits Hayyafit’s liability where, and to the extent that, such liability cannot be excluded or limited under the laws of the Kingdom of Saudi Arabia, including any liability arising from fraud, gross negligence, or wilful misconduct.
17 Indemnification
Each User agrees to indemnify, defend, and hold harmless Hayyafit, its officers, directors, employees, and agents from and against any claim, loss, liability, cost, or expense arising from or in connection with:
- the User’s access to or use of the Platform;
- any User Content submitted by the User;
- any breach by the User of these Terms or applicable Saudi Law;
- any injury or damage caused by the User to a third party in connection with Platform activities;
- any claim that User Content infringes a third party’s intellectual property rights.
This indemnity applies only to the extent that the relevant loss results from the User’s breach of these Terms or wrongful act or omission, and is enforceable only to the extent permitted under the laws of the Kingdom of Saudi Arabia. Hayyafit will notify the User of any claim to which this indemnity applies and will not settle such claim without prior consultation with the User where reasonably practicable.
18 Account Suspension and Termination
18.1 Suspension
Hayyafit may suspend or restrict a User’s Account immediately where the User is in breach of these Terms, poses a risk to other Users, or is engaged in fraudulent or illegal activity.
18.2 Termination by Hayyafit
Hayyafit may permanently terminate an Account for repeated or serious breaches. Upon termination, the User’s access to the Platform ceases immediately.
18.3 Termination by User
Users may terminate their Account through Platform settings or by contacting Hayyafit support. Deletion will be processed in accordance with the Privacy Policy.
18.4 Inactive and Dormant Accounts
Hayyafit may classify an Account as dormant following a prolonged period of inactivity of twenty-four (24) months. Hayyafit may restrict, suspend, or close dormant Accounts after giving notice to the User where reasonably practicable.
18.5 Effect of Closure and Retention
Upon closure of an Account, the User’s right to access and use the Platform ends. Personal data will be handled in accordance with the Privacy Policy and applicable legal retention requirements.
19 Data Protection
19.1 Privacy Policy
Hayyafit processes Users’ personal data in accordance with its Privacy Policy, incorporated into these Terms by reference.
19.2 PDPL Compliance
Hayyafit is committed to processing personal data in compliance with the PDPL (Royal Decree No. M/19 of 1443H, as amended by Royal Decree No. M/148 of 1444H). Users may exercise data subject rights as described in the Privacy Policy.
20 Updates to Terms
20.1 Right to Amend
Hayyafit may amend these Terms at any time. Amended Terms will be posted on the Platform with a revised effective date. Material amendments will be communicated to Users.
20.2 Continued Use
Continued use of the Platform after amendment constitutes acceptance of the revised Terms.
21 Miscellaneous
21.1 Governing Law and Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including any non-contractual dispute or claim), are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Before commencing any court proceedings, the parties shall first seek to resolve the dispute in good faith through Hayyafit’s internal complaint-handling process. If the dispute is not resolved within sixty (60) days of being raised through that process, either party may refer it to the courts of competent jurisdiction in the Kingdom of Saudi Arabia. Nothing in these Terms excludes or limits any mandatory right or protection available to a User as a consumer under the laws of the Kingdom of Saudi Arabia, including under the E-Commerce Law and applicable consumer-protection rules, which cannot be excluded or restricted by agreement.
21.2 Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and other Platform policies, constitute the entire agreement between the User and Hayyafit.
21.3 Severability
If any provision is found unlawful or unenforceable, it shall be severed and the remaining provisions shall remain in full force.
21.4 Waiver
No failure by Hayyafit to exercise any right constitutes a waiver of that right. Any waiver must be in writing.
21.5 Language
These Terms are made available in Arabic and English. In the event of any inconsistency or conflict between the Arabic and English versions, the Arabic version shall prevail.

22 Electronic Contracting and Communications
22.1 Binding Electronic Acceptance
By clicking “Accept”, “Register”, “Book”, or any similar control, or by otherwise accessing or using the Platform, the User enters into a legally binding agreement on these Terms. Such electronic actions satisfy any legal requirement for a signature or for the agreement to be in writing.
22.2 Electronic Records as Evidence
The User agrees that Hayyafit’s electronic records, logs, and communications constitute valid and admissible evidence of the User’s actions and of any agreement formed through the Platform.
22.3 Electronic Notices
Notices and communications may be given electronically, including by email, in-Platform message, or notice posted on the Platform, and are deemed received when sent or posted.
23 Platform Security and Prohibited Technical Conduct
Users must not, and must not permit any third party to: (a) access the Platform by automated means, including bots, crawlers, or scrapers, except as expressly permitted; (b) harvest or extract data from the Platform; (c) reverse engineer, decompile, or disassemble any part of the Platform; (d) circumvent or interfere with any security, authentication, or access-control mechanism; (e) access or use any Platform application programming interface (API) without authorisation; (f) introduce any malware or other harmful code; or (g) impose an unreasonable load on, or otherwise disrupt, the Platform’s infrastructure. Hayyafit may block, suspend, or terminate access for any breach of this clause.
24 Complaint Handling
24.1 How to Complain
Users may submit complaints through the in-Platform support channel or by email to support@hayyafit.com.
24.2 Acknowledgement
Hayyafit will acknowledge complaints within 5 business days of receipt.
24.3 Investigation
Hayyafit will investigate complaints in good faith and may request further information from the User or the relevant Facility Provider.
24.4 Response
Hayyafit will provide a substantive response within 30 days of receipt, or within such period as required by applicable Saudi law.
24.5 Escalation
If a complaint is not resolved, the User may escalate it in accordance with clause 21.1 and may refer the matter to the competent Saudi authority or to the courts of competent jurisdiction.
25 Artificial Intelligence
25.1 Use of AI
The Platform may use automated tools and artificial intelligence, including for sports partner matchmaking (Find a Buddy), recommendations, content moderation, fraud detection, and analytics.
25.2 Nature of AI Outputs
AI-generated outputs, suggestions, and matches are provided on an “as is” basis, may not be accurate or complete, and do not constitute professional advice. They do not guarantee any particular result, including that a User will find a suitable sports partner.
25.3 Human Oversight
Hayyafit does not take decisions producing legal or similarly significant effects on a User based solely on automated processing without human involvement, except where permitted by applicable law.
25.4 Data Protection
The processing of personal data in connection with these features is described in the Privacy Policy.
26 Accessibility
Hayyafit is committed to improving the accessibility of the Platform and to making reasonable efforts to align with recognised accessibility standards. Users who encounter accessibility barriers may contact support@hayyafit.com so that Hayyafit can seek to assist.
