User Content Policy

This User Content Policy (“Content Policy”) sets out the rules governing all content uploaded, posted, shared, or submitted by Users through the Hayyafit platform (“Platform”). This Policy forms part of and should be read together with the Hayyafit Terms of Use.
By submitting any content to the Platform, you confirm that you have read and understood this Policy and agree to comply with it. Violation of this Policy may result in content removal, account suspension, or account termination.
1 What Is User Content
1.1 Definition
“User Content” means any text, images, photographs, video recordings, audio clips, reviews, comments, ratings, sports results, profile information, and any other material that a User creates, uploads, posts, shares, or submits through the Platform in any format.
1.2 Scope
This Policy applies to all User Content submitted through any feature of the Platform, including: (a) profile photographs and personal descriptions; (b) sports activity posts and media; (c) facility reviews and ratings; (d) Find a Buddy posts and messages; and (e) comments and responses to other Users’ content.
2 Content Standards
2.1 General Standard
All User Content must be accurate, lawful, respectful, and appropriate for a diverse sports community. Users are solely responsible for all content they submit.
2.2 Prohibited Content
Users must not submit content that:
- is unlawful or encourages any illegal activity under Saudi Law, including the Anti-Cybercrime Law (Royal Decree No. M/17 of 1428H);
- is defamatory, obscene, indecent, sexually explicit, or contrary to public order or morals;
- constitutes harassment, bullying, abuse, or targeted threats directed at any individual or group;
- promotes or glorifies discrimination based on religion, gender, nationality, or other protected characteristics;
- contains false or misleading information about any person, facility, or sports event;
- includes the personal data of third parties without their express consent, in breach of the PDPL;
- features identifiable minors in any inappropriate or exploitative manner;
- infringes the intellectual property rights, privacy rights, or other rights of any third party;
- constitutes spam, unsolicited advertising, or commercial solicitation not authorised by Hayyafit;
- attempts to impersonate any other person or entity or misrepresent the User’s identity.
2.3 Sports Context Requirement
The Platform is a sports-focused community. Users should ensure that all content is relevant to sports, fitness, or physical activity. Content that has no connection to sports may be removed at Hayyafit’s discretion.
3 Media Content Rules
3.1 Consent for Third-Party Images
Users must obtain the express prior consent of any identifiable individual before uploading or posting media content featuring that individual. This obligation applies to photographs, videos, and audio recordings captured in any context, including at sports facilities, public sports events, or during informal sporting activities.
3.2 No Copyrighted Material
Users must not upload media that incorporates third-party copyrighted material, including broadcast footage, music recordings, or photographs taken by others, without holding the appropriate licence or rights.
3.3 Accuracy of Facility Media
Users posting photographs or videos of sports facilities must ensure that such media accurately represents the facility as it currently exists. Misleading or outdated facility media may be removed.
4 Ownership and Licence
4.1 User Retains Ownership
Users retain all intellectual property rights in User Content they submit to the Platform. These terms do not transfer ownership of User Content to Hayyafit.
4.2 Licence to Hayyafit
By submitting User Content, the User grants Hayyafit a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, store, reproduce, display, adapt, and distribute the User Content for the purpose of operating and promoting the Platform. This licence continues until the User Content is deleted, subject to legal retention requirements.
5 Content Moderation
5.1 Platform Moderation Rights
Hayyafit reserves the right to review, moderate, remove, restrict visibility of, or disable access to any User Content that, in Hayyafit’s reasonable determination, violates this Policy, the Terms of Use, applicable Saudi Law, or community standards.
5.2 Proactive and Reactive Moderation
Hayyafit may moderate content proactively (through automated tools or human review) or reactively (in response to reports from Users). Hayyafit is not obligated to monitor all User Content but may do so.
5.3 User Reporting
Users may report content they believe violates this Policy through the in-Platform reporting mechanism. Hayyafit will investigate all good-faith reports in a reasonable time. Hayyafit does not guarantee any particular outcome in response to a content report.
5.4 Appeals
Users whose content is removed may submit an appeal to Hayyafit support within 14 days of receiving notification of removal. Hayyafit will review the appeal in good faith and notify the User of the outcome. Hayyafit’s determination on appeal is final.
5.5 Emergency Removal
Hayyafit may immediately remove or disable access to any content that it reasonably considers to be illegal under Saudi Law or to pose a risk to safety, without prior notice.
5.6 Notice and Takedown
Any person may notify Hayyafit of allegedly illegal or infringing content through the in-Platform reporting mechanism or by contacting Hayyafit support. Hayyafit will review valid notices and may remove or restrict the content concerned and cooperate with the relevant Saudi authorities where required.
6 User Editing and Deletion
6.1 Self-Editing
Where technically available, Users may edit, update, or delete their own User Content through the Platform interface.
6.2 Support Requests
Where the User cannot delete content directly through the Platform interface, the User may submit a deletion request to Hayyafit support. PDPL data subject deletion requests will be processed in accordance with the Privacy Policy.
6.3 No Obligation to Restore
Hayyafit is under no obligation to restore deleted or removed content and shall not be liable for any loss arising from the unavailability of User Content.
7 Consequences of Policy Breach
7.1 Enforcement Actions
Where a User breaches this Policy, Hayyafit may, depending on the nature and severity of the breach: (a) remove the non-compliant content; (b) issue a warning to the User; (c) temporarily restrict the User’s ability to post content; (d) suspend the User’s Account; or (e) permanently terminate the User’s Account.
7.2 Reporting to Authorities
Hayyafit reserves the right to report content that may constitute a criminal offence under Saudi Law — including content prohibited under the Anti-Cybercrime Law — to the relevant Saudi law enforcement authorities.
7.3 Repeat Infringers
Hayyafit may suspend or permanently terminate the Account of any User who repeatedly breaches this Policy.
